1. 00 [Pematuhan Terma Penggunaan / Compliance with the Terms of Use]

   "Terma dan Syarat" berikut ditulis dalam bahasa Inggeris. Semua pengguna bersetuju dan memahami bahawa versi bahasa Inggeris adalah "Terma dan Syarat rasmi berbanding mana-mana versi terjemahan.
   
   The following "Terms of Use" are written in English. All users agree and understand that the English version is the official "Terms of Use" over any translated versions.

2. 01 [Perjanjian / Agreement]

   Pengguna bersetuju untuk mematuhi "Terma dan Syarat ini apabila mengambil bahagian dalam perkhidmatan yang disediakan dari kedai. Perkhidmatan tidak akan disediakan tanpa persetujuan dalam apa jua keadaan.
   
   Users agree to comply with these "Terms of Use" when participating in services provided by the store. Under no circumstances will services be provided without agreement.

3. 02 [Syarat Pengguna / User Condition]

   Pengguna mesti memenuhi 4 syarat berikut sebelum menggunakan perkhidmatan kami.
   
   Users must meet all of the following 4 conditions. If any one of the conditions is not met, users cannot use the service. If it is found that users are using the service despite not meeting the conditions, users acknowledge that insurance will not apply.

   A) A. Pengguna mesti berumur 18 tahun ke atas
   
   A) Users must possess a valid driver's license or permit to drive in Japan (such as an International Driving Permit based on the 1949 Geneva Convention, SOFA license, etc.).

   B) B. Pengguna mesti mempunyai lesen memandu yang sah
   
   B) Users must have sufficient driving skills to use the service.

   C) C. Pengguna mesti bersetuju dengan semua terma dan syarat yang dinyatakan dalam perjanjian ini

4. 03 [Pematuhan Undang-undang Lalu Lintas / Compliance with Traffic Laws]

   Pengguna mesti mematuhi semua undang-undang lalu lintas tempatan dan kebangsaan semasa mengendalikan kart.
   
   Users must comply with all local traffic laws and regulations. Users must possess and carry at all times a valid driver's license or permit to drive in Japan. Users must have sufficient driving skills to operate a kart.

5. 04 [Tanggungjawab Kart / Kart Responsibility]

   Pengguna bertanggungjawab sepenuhnya terhadap kart semasa tempoh sewa dan mesti memulangkannya dalam keadaan yang sama seperti diterima.
   
   In Japan, it is the user's responsibility by law to ensure that the kart is roadworthy and free from malfunctions that would violate local traffic laws (e.g., side signal lights, headlights, taillights, brake lights, brakes, accelerator).

6. 05 [Pelanggaran Undang-undang Lalu Lintas / Violation of Traffic Laws]

   Sebarang pelanggaran undang-undang lalu lintas adalah tanggungjawab Pengguna semata-mata, dan mereka akan bertanggungjawab untuk semua denda dan akibat undang-undang.
   
   Each user is responsible for any traffic violations. The shop or tour guide is not responsible for fines or fees incurred due to violations.

7. 06 [Denda Tidak Diselesaikan / Unresolved Fines]

   Jika denda tidak dibayar dalam masa yang ditetapkan, kos akan dicaj kepada kad kredit berdaftar Pengguna.
   
   The shop may charge users for unresolved fines or fees incurred regarding traffic violations with local authorities.

8. 07 [Kemalangan Lalu Lintas / Traffic Accidents]

   Sekiranya berlaku kemalangan lalu lintas, Pengguna mesti segera menghubungi polis dan syarikat.
   
   In the event of a traffic accident, users must notify the tour guide, local authorities, and insurance company.

9. 08 [Penyelesaian Tidak Dibenarkan / Unauthorized Settlement]

   Pengguna dilarang daripada membuat sebarang penyelesaian peribadi dengan pihak ketiga tanpa kebenaran bertulis daripada syarikat.
   
   In the event of a traffic accident, users agree not to agree to settlements with the other party without the shop's consent. The shop is not responsible for settlement agreements made without consent between users and other parties.

10. 09 [Insurans Kart / Kart Insurance]

    Semua kart diinsuranskan, tetapi Pengguna menanggung tanggungjawab untuk membayar deduktibel insurans sekiranya berlaku kemalangan.
    
    All karts are insured against accidents. The insurance coverage is limited and regulated. In the event of an accident, the insurance company will evaluate the case. At this point, users must pay a deductible of 50,000 yen. If the insurance company evaluates that the accident was the result of reckless driving, users may not receive compensation.

11. 10 [Kerosakan Kart / Kart Damages]

    Pengguna akan dicaj untuk kos membaiki sebarang kerosakan pada kart semasa tempoh sewa.
    
    Users are responsible for any damage to the kart. Users understand that the shop will charge for actual damages. Damages involving the insurance company are subject to Article 9. The shop has the right to claim damages.

12. 11 [Aktiviti Jenayah / Criminal Activity]

    Menggunakan kart untuk sebarang aktiviti jenayah adalah dilarang keras dan akan mengakibatkan pembatalan kontrak serta-merta dan pendakwaan undang-undang.
    
    Users agree that they are not members of criminal organizations and do not participate in criminal activities.

13. 12 [Pajakan Semula Kart / Subleasing Karts]

    Pengguna dilarang daripada mempajak semula kart kepada orang lain atau membenarkan mereka memandunya tanpa kebenaran bertulis.
    
    Users may not allow others to drive or ride the kart unless designated by the shop or tour guide.

14. 13 [Kegunaan Komersial / Commercial Use]

    Menggunakan kart untuk tujuan komersial adalah dilarang tanpa perjanjian berasingan dengan syarikat.
    
    Rented karts are not permitted for commercial use (delivery services, advertising) without the shop's permission.

15. 14 [Pemulangan Kart / Return of Karts]

    Kart mesti dipulangkan pada masa dan tempat yang ditetapkan, jika tidak yuran tambahan akan dikenakan.
    
    For tour customers, users are not responsible for refueling after the tour ends. For freelance rental, except for necessary maintenance, users must not modify vehicles by applying stickers or installing devices without the shop's consent. Furthermore, vehicles must be returned in original condition, and users must fill the fuel tank before returning. If users do not return the vehicle with a full tank, they must pay the fee set by the shop.

16. 15 [Dasar Masa Lebihan / Over Time Policy]

    Yuran tambahan sebanyak 1000 yen dikenakan untuk setiap 10 minit kelewatan melebihi masa pemulangan yang ditetapkan.
    
    This clause does not apply to tour customers. For freelance rental, users promise to return vehicles at the location and time designated by the shop. If users exceed the rental time, they must obtain the shop's consent and pay a late fee.

17. 16 [Hak Cipta / Copyrights]

    Semua bahan promosi dan tanda dagangan dimiliki secara eksklusif oleh syarikat dan tidak boleh digunakan tanpa kebenaran.
    
    Users agree not to make any claims regarding copyrights, portrait rights, and publicity rights concerning photographs related to the use of karts and services provided.

18. 17 [Tuntutan Ganti Rugi / Claims for Damages]

    Sebarang tuntutan pampasan mesti dikemukakan secara bertulis dalam tempoh 30 hari dari tarikh kejadian.
    
    If users violate these terms of use, users acknowledge that they will compensate for any claims made by the shop regarding damages or penalties related to violations.

19. 18 [Keputusan Kedai / Shop Decision]

    Keputusan syarikat mengenai pertikaian dan tuntutan adalah muktamad dan mengikat semua pihak.
    
    Users understand that the shop and tour guide have the right and authority to stop individual users from driving karts in response to safety risks (such as reckless driving, non-compliance with tour rules). Users will return karts as designated by the shop or tour guide.

20. 19 [Penafian Kedai / Shop Disclaimer]

    Syarikat tidak bertanggungjawab untuk sebarang kerosakan tidak langsung atau kerugian yang mungkin timbul daripada menggunakan perkhidmatan kami.
    
    The shop assumes no responsibility and/or obligation for any damages incurred by users. The shop has the right to stop, cancel, and modify services provided to users.

21. 20 [Liputan Akhbar / Press Coverage]

    Syarikat boleh menggunakan foto atau video pelanggan untuk tujuan promosi tanpa pampasan tambahan.
    
    Users may not collect data, information, and images in connection with media distribution. Users may not collect data without the shop's permission.

22. 21 [Perubahan kepada Terma dan Syarat / Changes to the Term and Conditions]

    Pengguna memahami bahawa Terma dan Syarat mungkin dikemas kini tanpa notis atau kelulusan daripada pengguna.
    
    Users understand that the terms of use may be updated without notification or approval to users.

23. 22 [Harga Ulasan / Review Price]

    Kami percaya bahawa berkongsi dan membincangkan pengalaman perjalanan dengan orang lain adalah salah satu kegembiraan sebenar dalam perjalanan. Oleh itu, untuk menggalakkan tetamu berkongsi pengalaman mereka dengan keluarga, menulis tentangnya di blog, atau menyiarkannya di media sosial, kami menawarkan program harga ulasan. Harga ulasan ini terpakai apabila pengguna menunjukkan kesediaan mereka untuk berkongsi pengalaman mereka.
    Memandangkan kes di mana pengalaman tidak dikongsi adalah sangat jarang berlaku, harga ulasan ini digunakan secara automatik melainkan pengguna secara khusus menolaknya.
    (Kami tidak mengesahkan sama ada ulasan sebenarnya telah disiarkan atau pengalaman dikongsi. Syarat kelayakan hanyalah menunjukkan "kesediaan untuk berkongsi pengalaman.")
    Walau bagaimanapun, sesetengah platform media sosial, seperti TripAdvisor dan Google, melarang penulisan ulasan sebagai pertukaran untuk diskaun. Oleh itu, diskaun ini tidak terpakai pada platform tersebut.
    Jika atas apa-apa sebab anda lebih suka tidak berkongsi pengalaman anda, sila maklumkan kepada kami. Kami akan memberikan anda harga biasa. Dan jika anda memintanya, kami akan merahsiakan pengalaman anda.
    
    We believe that sharing and discussing travel experiences with others is one of the true joys of travel. Therefore, to encourage guests to share their experiences with family, write about them on blogs, or post on social media, we offer a review price program. This review price applies when a user indicates their willingness to share their experience.
    Since cases where experiences are not shared are extremely rare, this review price is automatically applied unless user specifically decline it.
    (We do not verify whether a review was actually posted or the experience shared. The qualifying condition is simply indicating user's "willingness to share the experience.")
    However, some social media platforms, such as TripAdvisor, Google, prohibit writing reviews in exchange for discounts. Therefore, this discount does not apply on those platforms.
    If for any reason you prefer not to share your experience, please let us know. We will provide you with the regular price. And if you request it, we will keep your experience confidential.
